FDI & Wrigley Photographic Award 2009 Terms and Conditions

NO PURCHASE NECESSARY

1. This prize draw is open to members of the dental profession and students who are registered at dental and/or hygiene schools who are aged 18 and over.

2. Employees of FDI or Wm. Wrigley Jr. Company and its affiliates and subsidiaries (collectively, “Wrigley”), its agencies, their families, or anyone professionally associated with the prize draw are not eligible to enter. Entries by agents or any party acting on behalf of the entrant will not be accepted.

3. To enter this promotion, submit a photo to the www.PhotoAward.org website in accordance with the website's terms of use.

4. Judging criteria is based on creativity in showing “what makes you smile.”

5. There are six regional winner prizes to be won in this promotion. One regional winner prize of gift vouchers worth $1,000USD will be awarded to a winner from each of the following geographical regions; Europe, North America, Latin America, Africa, Asia Pacific and Oceania and the Middle East. Regional winners will also receive a one-year subscription to the International Dental Journal and a year’s supply of Wrigley chewing gum (approximately 144 packs).

6. Of the regional winners, an overall winner will be chosen who, in addition, will receive an expense paid trip to either the 2009 or 2010 FDI Annual World Dental Congress (2-5 September 2009 in Singapore or 2-5 September 2010 in Salvador da Bahia, Brazil). This overall winner prize will comprise of a coach class flight for one person to the meeting city, 4 nights hotel accommodation (double occupancy) (minimum 4 Star standard), a full complimentary congress registration and $500USD spending money for winner only. In addition, the grand prize winner may have the option of EITHER upgrading to a business class air ticket OR bringing a companion at the coach rate. If winner elects to bring a guest, winner and guest must travel on the same itinerary.

7. In addition, after the above winners have been selected, 50 names will be drawn at random from the total remaining entries, and those 50 will receive a year’s supply of Wrigley chewing gum.

8. The judging panel will include an internationally renowned photographer, as well as a representative from the FDI and Wrigley.

9. For every entry submitted, up to 1,000 entries, Wrigley Oral Healthcare Programs will donate $25 USD to the FDI World Dental Development Fund to support oral health education and projects worldwide.

10. The closing date for entry into this promotion is 8 July 2009.

11. No responsibility is accepted for late, lost, delayed, corrupted, illegible or incomplete entries to this promotion, which shall be disqualified at the absolute discretion of the Promoter, or for transmission and/or computer error affecting the logging of entries to this promotion. Proof of sending will not be accepted as proof of delivery.

12. The winners will be notified by email by no later than 4 August 2009. In the event that a winner does not respond within two-weeks of notification the FDI reserves the right to withdraw the prize offer.

13. The winners agree to participate in post promotion publicity if required.

14. The Prizes are as stated and are non-transferable, non-upgradeable and subject to space availability. No cash alternatives will be offered. The overall winner is responsible for all other expenses not specifically identified herein, including without limit travel insurance and for ensuring that they (and their guests) have a passport and visa valid for the trip. Travel is exclusively for the period of the FDI Annual World Dental Congress (2-5 September 2009 in Singapore OR 2-5 September 2010 in Salvador da Bahia, Brazil)

16. Please read these terms of use carefully before you start to use the www.PhotoAward.org website (the "Site"). By using the Site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, you must not use this Site.

17. Information about us

17.1 This Site is operated by FDI World Dental Partners Ltd (company number: 03919706) of the address as set out in Paragraph 15 above (hereinafter "we" / "us").

18. Uploading your photos

18.1 You are solely responsible for all photographs or other materials ("Photo(s)") that you upload to the Site, and agree that all Photos uploaded by you will be your own original work and will not have been previously published. You affirm that you have obtained consent from any people appearing in the photographs that you have submitted for the Award.

18.2 You agree not to upload any Prohibited Content to the Site. "Prohibited Content" includes material which: is unlawful, harmful, threatening or harassing, abusive, defamatory, obscene or otherwise objectionable; contains nudity, violence or offensive subject matter; infringes any intellectual property rights or other rights of any third party; and/or contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

18.3 You also agree not to: interfere with or disrupt the Site, or the servers or networks connected to the Site; use any information obtained from the Site in order to harass, abuse or harm any individual; and/or use the Site in breach of any applicable laws and regulations.

18.4 FDI reserves the right not to publish images submitted for this competition on the www.PhotoAward.org website. FDI reserves the right (but not the obligation) to refuse or remove any Photos that are available via the Site, including without limitation the right to remove any Prohibited Content.

18.5 We do not guarantee the accuracy, integrity or quality of the Photos uploaded to the Site.

19 Availability of the Site

19.1 We will endeavour to allow uninterrupted access to the Site, but access to the Site may be suspended, restricted or terminated at any time.

19.2 We reserve the right to change, modify, substitute or remove without notice any information on the Site from time to time.

20 Intellectual property

20.1 All intellectual property rights in Photos uploaded by you onto the Site will be retained by you. However by uploading any Photos onto the Site you hereby grant to the FDI and Wrigley a perpetual, non-exclusive, worldwide and royalty-free license (with the right to sub-license) to use, reproduce, modify, adapt, publish and distribute such Photos on and through the Site (including without limit the right to make such Photos available for download by end-users and to be copied and used by end-users), on outdoor poster sites and elsewhere, and in any and all other media for publicity and marketing purposes as we in our sole discretion see fit. Your name will be used or not used in acknowledgement at the discretion of the FDI.

20.2 The copyright, database rights and other intellectual property rights vesting in the material contained in the Site (excluding any Photos uploaded, posted or otherwise transmitted by users), together with the Site design, text and graphics, and their selection and arrangement, and all software compilations, underlying source code and software belong to us. All rights are reserved. None of this material may be reproduced or redistributed other than in accordance with the instructions found on the Site or with our prior written permission.

20.3 FDI and the FDI logo are our trade marks. You must not use these trade marks without our prior written permission.

21 Links

21.1 The Site may include links to other internet sites. We make no representations or warranties about those sites or their content, nor that the links work.

22. Changes to these terms of use

22.1 Any variations to these terms of use shall be inapplicable unless agreed in writing by us. We may change or supplement these terms of use from time to time. These changes shall form part of these terms of use, even if you do not re-visit this page to re-read the terms of use, unless we receive written notification from you that you do not agree to be so bound.

23 Termination

23.1 You agree that we may in our sole discretion remove and permanently delete any Photos on the Site for any reason without notice, including without limitation if you appear to us to be in breach of any provision of these terms of use.

23.2 We may also in our sole discretion discontinue providing the Site or any part thereof at any time, without notice.

23.3 All disclaimers, indemnities and exclusions in these terms of use and the provisions of section 5 shall survive termination of this agreement for any reason.

24 Your information

24.1 We collect your name, email address and mailing address when you upload Photos to the Site. Except as noted in section 24.2 we do not collect any other information via the Site.

24.2 We may also collect information about your computer, including where available your IP address, operating system and browser type, for system administration. This is statistical data about our users' browsing actions and patterns, and does not identify any individual. For the same reason, we may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our site and to deliver a better and more personalised service.

24.3 We will store your name and email address collected via the Site on our secure servers, and will only use this information as follows:

To let you know if your Photo is intended to be used in poster sites and/or elsewhere; and (subject to you indicating your express consent by clicking the appropriate tick-box) to send you news and updates regarding our products, services and activities. We will not use or disclose this information for any other purpose whatsoever, including without limit any marketing purposes, except where required by law.

24.4 You can contact us to ask whether we are keeping personal data about you by sending an email to photoaward@fdiworldental.org. Upon request we will provide you with a readable copy of data which we hold about you. If you ask us to delete, correct or amend that personal data we will do so within a reasonable time.

25 Our liability

25.1 Except as expressly provided in these terms of use, we expressly disclaim any further representations, warranties, conditions or other terms, express or implied, by statute, collaterally or otherwise, including but not limited to implied warranties, conditions or other terms of satisfactory quality, fitness for a particular purpose or reasonable care and skill.

25.2 We shall not be liable in contract, tort (including negligence), statutory duty or collaterally or otherwise arising out of or in connection with these terms of use and/or the Site for any loss or damages suffered as a result of any use of the Site, including but not limited to direct, indirect, consequential or special loss or damage or any economic losses (including loss of revenues, profits, contracts, business or anticipated savings), in each case even if we have been advised of the possibility of such loss or damage and howsoever incurred (but not including liability for death or personal injury caused by our negligence, liability for fraudulent misrepresentation and any other liability which cannot be excluded or limited under applicable law).

26 Your liability

You undertake to indemnify Wrigley, FDI, its subsidiaries, affiliates and partners, and their respective officers, agents, partners and employees, and keep them indemnified fully at all times against all claims, demands, proceedings, damages, losses, costs, expenses, fines and charges which are made or brought against or incurred by them due to or arising out of any use of the Photos you upload onto the Site, your use of the Site, your participation in the Photographic Award, your acceptance/use of any prizes, and/or your breach of these terms of use.

27 Assignment

27.1 You may not transfer any of your rights or delegate any of your obligations under these terms of use without our prior written consent.

27.2 If we fail to enforce any provision of these terms of use, that failure will not preclude us from enforcing either that provision (or any similar provision) on a later occasion.

28 Applicable law

28.1 This Agreement is governed by UK law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the UK courts.
